These Terms & Conditions (“Terms”) of (a) use of our website www.ecbse.in (“Website”), our applications (“Application”) or any products or services in connection with the Application/, Website/products (“Services”) or (b) any modes of registrations or usage of products, including through SD cards, tablets or other storage/transmitting device are between Shree Ram Ventures (“Company/We/Us/Our”) and its users (“User/You/Your”).

By using our Services, you are agreeing to these terms. Please read them carefully.

INTRODUCTION

www.ecbse.in is an online portal which has aspired to merge creative learning methods, technologies and advanced information and interaction technologies to provide unconventional and reasonable solutions to the education sector of society.

If you use or access the Site, Application or Services or download or publish any content from or on the Site, you would be specifying that you read, understand and agree to be obligated by these terms and avail our Services whether you have enrolled or not with the Site and/or Application.

Please carefully read and understand the Terms and conditions along with the privacy policy of the Company so as to learn about the method of registration, the use of the Application, Website, Services and products before you use or access the Application, Website, products or services. In the case of any conflict between the Terms and any other policies associated with the Application or Website or there is any issue or conflict regarding the Services or products, the provisions and facilities of the Terms shall prevail.

These terms and conditions will also cover the offerings with the assortment of any product granted or imparted by ECBSE. These Terms, Privacy Policy and other policies given on the Website must be read side by side. Your acceptance to these Terms makes you to be legally obligated by the same.

If you do not accept the Terms or the Privacy Policy, kindly do not use the Application or Website. Any access to our Services/Application/products through registrations/subscription is entailed.

These Terms of Service are binding statements between you and ECBSE, if you are operating the Site, Application or Services.

After any change in the terms, your sustained use of the Service, incorporate your acceptance and agreement of the new Terms of Use.  If you do not accept any of these terms or any kind of future Terms, kindly stop accessing the Services or website.

You accept to be legally obligated by the terms and conditions by operating the Site, using the Applications or Services, whether you are registered user or not. The said services are personal in nature and cannot be shared with any other person.

You may own the medium on which the content, material or information is available, but the company shall at all times withhold the full information, content or materials and all academician property rights put by the company on such platform.

There may be different terms and conditions, standards, guidelines, or policies for certain areas of the Site and Application that may have been posted or may require you to accept additional terms and conditions. If there is a conflict between these Terms and terms and conditions posted for a specific area of the Site, Application, Services, or Collective Content, the latter terms and conditions will take primacy with respect to your use of or access to that area of the Site, Application, Services, or Collective Content.

If you accept these Terms in the place of a company or other legal organisation, you indicate that you are certified to bind that company or other legal organisation to these Terms and, in such event, "you" and "your" will refer and apply to that company or other legal organisation.

USE OF SERVICES

Eligibility: If you are under the age of 18 years and over the age of 13 years, you are permitted to use the Site and application under the supervision of a parent or legal guardian. In such cases, where a minor below the age of 18 years of age and wants to use this application or website, on behalf of such minor, parents or guardians can register and such a parent/ guardian shall accept the agreement on and bind him / her in accordance with all terms and conditions documented.

Registration: To access the services given on the website or application and make purchases, it is necessary to create an account.

  • A user may create an account on the website or application which shall gather only your basic information.
  • To create an account, you must select a username and verify your mobile number. 
  • You must register to create an account and become a member to access certain features of the site and application, and to enrol for courses. To register yourself as user, you must give accurate information and keep updating the information over the period of time without undue delay.
  • By registering yourself as a user to avail the services of this website and application, it will be considered that you have read, understood and agreed to fully abide by all the terms and conditions of the Website and application as mentioned.
  • You are completely responsible for safeguarding your username and any activity under the account will be considered to have been done by you. You accept that you will not share your details to any third party and that you will take sole responsibility for any activities or actions under your ECBSE Account, whether or not you have authorized such activities or actions
  • In the event you provide us with fake and inaccurate details, ECBSE has valid reasons to believe that fake and inaccurate information has been furnished, we hold the right to permanently suspend your account.

Post Registration: ECBSE may contact you through the registered mobile number or e-mail or any other mobile number or contact number or email provided by you upon registration through any means for allowing the use of services. The user expressly grants the permission to the company to contact him/her and the student using the Services, through the above listed means at any time post registration. Further, ECBSE shall have the right to watch or keep an eye on the download and usage of the Application/Services/products and the contents thereof by the User/student, to assess such usage and discuss the same with the User/student to enable effective and systematic usage of the Services. The user allows ECBSE to make sure that student clear all the doubts by using the Application/Services/online portal by answering the questions, keeping the record of the progress, providing feedback, communicating with the student and guiding the student through telephone or e-mail on the consent of the legal guardian/parent of the User or through any other forum.

Course catalogue: ECBSE will provide the details about the course, including, but not limited to, the subject, topic, number of sessions, mode of conduct, and time slots of the lectures. The various pricing and related rules and financial terms will be provided on the site and the application. These details will be made available to the public via the Site, Application and Services. Students will be able to look the courses via the Site, Application and Services based upon the information provided in the details, student needs, preferences, choices and search parameters. We understand and accept that once a student requests enrolment for a course, we may not ask the student to pay the high amount than that described in the Site or Application.

License: With respect to your compliance with these Terms, ECBSE provides you a limited, non-exclusive, non-transferable license, to access and look for any content on each mobile device or tablet to which you are granted access, solely for your personal and non-commercial purposes. It means that any resale or commercial purpose of the site or its contents, any gathering and any downloading or copying of information for the benefit of another merchant is prohibited by such limited sub- license. Any content or any portion of the website and application may not be copied and duplicated or reproduced, sold, resold, visited, or otherwise exploited for any commercial purpose without the written approval of ECBSE. You may not use the reconstructive techniques to include any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Website or of the Company and/or its affiliates without the express written approval of the Company. You will not use, copy, adapt, change or create derivative works based upon, distribution, license, sell, transfer, publicly display, transmit, broadcast or otherwise it will be considered as exploitation of the terms of Site, Application, Services, or Collective Content, except as expressly permitted in these Terms.

User Conduct: You understand and accept that you are completely responsible for conformity with any and all laws, rules, regulations, and tax obligations that may apply to your use of the Site, Application, Services and Collective Content. In connection with your access of the Site, Application, Services and Collective Content, you agree that you will not:

  • Break any local, state, national, or other law or regulation, or any order of a court, including, without limitation, Tax regulation.
  • Duplicate, store or otherwise use any information available on the Site, Application, Services or Collective Content for the motives which are not allowed or permitted according to these Terms.
  • Attempt to use the Website and/or the materials or Services by any source other than through the interface that is provided by the website.
  • You ensure that such content or data is not offensive and in accordance with applicable laws in places where this website permits you to post or upload data/information. Further, you undertake not to:
    1. Publish or post any file that violates the copyright, patent or trademark of other legal entities.
    2. Abuse, harass, threaten, defame, disillusion, erode, abrogate, demean or otherwise violate the legal rights of others;
    3. Publish any content which consist of harmful, harassing, defamatory, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful information in any manner.
    4. Interrupt with or damage the services of Site, Application or Services, including, without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, backdoors, packet or IP spoofing, forged routing or electronic mail address information or similar methods or technology;
    5. Use automated scripts to collect information from or otherwise interact with the Site, Application, Services or Collective Content;
    6. Imitate any person or entity, or falsify or conceal yourself or your affiliation with any person or entity;
    7. Use, exhibit or frame the Site, Application, Services or Collective Content, or any individual element within the Site, Application, Services or Collective Content, ECBSE name, any ECBSE trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page in the Site, Application or Services, without ECBSE’s express written consent;
    8. Violate any code of conduct or other guidelines, which may be applicable for or to any particular Service;

ECBSE has the right to inquire about and conduct violations of any of the above to the fullest extent of the law. As mentioned in these Terms, ECBSE may take a range of actions against you, including but not limited to deactivating or cancelling ECBSE Account, for a violation of this Section or these Terms.

We shall have the right to remove or edit any content that in its sole discretion violates, or is reported to violate, any applicable law or letter of these Terms of Service. Not with standing this right, you remain solely responsible for the content of the materials you post on the website. In no circumstances, we have any responsibility or liability for any Content posted or for any claims, damages or losses resulting from the use of Content and/or appearance of Content on the Website. You hereby indicate that you have all essential rights in and to all Content provided by you and all information it contains shall not violate any proprietary or other rights of third parties or contain any unlawful information.

ECBSE reserves the right, at any time and without prior notice, to remove or discontinue access to any Collective Content that ECBSE, at its sole discretion, considers to be objectionable for any reason, in violation of these Terms or otherwise harmful to the Site, Application or Services.

Payment and terms: You as a Student accept to pay the Course Fees for any enrolment requested, in association with your ECBSE Account. ECBSE will take the Course Fees according to the Payments Terms. Once you're confirmed enrolment transaction is complete you will receive a verification email summarizing your confirmed enrolment. There are different payment methods are available on the Application:

  • Domestic and international credit cards issued by banks and financial institutions that are part of the Visa, Master Card & Amex Card networks;
  • Visa & Master Card Debit cards;
  • Netbanking/Direct Debit payments from selected banks in India. A list of available options will be made available at the time of the Purchase.
  • Payment Wallets

The user is hereby expressly made informed of that his/her card statements will indicate that a payment has been made in favour of the Company.

The user is further informed of that the merchant name may appear in an abbreviated format, and the Company has no control over the same in case of third party statements, including bank and credit card statements. The user is required to complete the transaction by making the payment for the services to successfully subscribe on the Website, and application

You agree and accept that ECBSE through its Site or Application would raise system generated invoice to the Student in relation to the Course for which the Student has enrolled or in relation to any kind of payment done, as per applicable laws. ECBSE will raise invoice for the above which shall be inclusive of all applicable Taxes.

Cancellations and Refunds: No refund will be made in respect of tuitions already provided if as a student, you wish to cancel a confirmed enrolment made via the Site or the Application, either prior to or after initiation of the course. Depending upon the terms of the applicable cancellation policy, refund of the Course Fees and other amounts charged to you will be considered. ECBSE will initiate any refunds due pursuant to the Payments Terms.

If we cancel a confirmed enrolment made via the Site, Services, and Application, (i) ECBSE will refund the Course Fees paid by the Student for such enrolment to the applicable Student pursuant to the Payments Terms which shall not exceed the total amount paid by the Student.

Copyright and Trademark: ECBSE values copyright law and expects that its users to do the same. It is ECBSE's policy that in appropriate circumstances the ECBSE may terminate the accounts of members or other account holders who repeatedly violate or are believed to be repeatedly violating the rights of copyright holders.  All the rights, including copyright, in and to the Site are owned by or licensed to the Company. Any use of the Site or its contents, including duplicating or storing it or them in whole or part is prohibited without the approval of the Company. No trademark or service mark license is allowed in relation with the materials available on the Site. Access to or use of the Site does not authorize anyone to use any name, logo or mark in any manner. 

Privacy: In order to provide the services to you, we collect some of your Personal Information. We give the information about our collection and use of personal information in our  Privacy Policy . You agree that ECBSE may disclose personal information provided to us, including the data entered into the Website, if required to by law or government request such as a warrant, or as specified in the  Privacy Policy . Please go through this policy.

Provisions:

  • Notice: You will receive all notices by the Company via email to your account or as a notification on the Application. ECBSE shall not hold any responsibility whether in contract, or otherwise for any losses whatsoever and howsoever caused.
  • Entire Agreement: The Terms along with the Privacy Policy, and any other guidelines made with respect to the use of the Application and the Services by the user make up the entire agreement between the Company and service receiver or user.
  • Assignment: You have no right to transfer your obligations under the Terms to any third party. Any attempt conducted by you to transfer these terms will be considered as null and of no effect without the consent from the company. Only ECBSE may assign these Terms without any restriction and without the requirement of seeking your consent at its sole discretion.
  • Severability: If for any reason provision of the agreement becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect the validity of other provisions in the agreement that means the remaining of the Terms shall continue in full force and effect.
  • Waiver: The failure of either party at any time to require performance of any provision of this Agreement shall not constitute a waiver by the Company of that provision or right. No waiver by either party of any breach of this Agreement, whether by conduct or otherwise, in any one or more instances, shall be deemed to be, or construed as, a further or continuing waiver of any other such breach, or a waiver of any other breach of this Agreement.

Termination: This User Agreement is valid and effective unless it is ceased either by the Company or by you. You have choice to discontinue this User Agreement at any time, provided that you shall stop further using or accessing Website. The ECBSE may immediately discontinue this Agreement without any notice if you have breached warranties documented in these Terms of the "User Conduct" provisions or when it is found that you have provided inaccurate, fraudulent, outdated or incomplete information during the ECBSE Account registration, or you have violated applicable laws, regulations or third party rights, or (iv), For the prevention of fraud, risk assessment and security ECBSE accordingly deny you access to the Site. This is because ECBSE believes that such action is reasonably necessary to protect the safety or property of other Members, ECBSE or third parties. Such termination will be without any responsibility to the Company. The termination of the User Agreement shall not affect any accountability that may have arisen under the User Agreement prior to the date of termination.

Feedback: Any feedback provided by you in regarding to the Application shall be considered to be non-confidential. Further, when you submit the feedback, you indicate that

  • Your feedback does not consist of any confidential information about You or about third parties;
  • The Company is not held responsible for the confidentiality, express or implied, in relation to the feedback;
  • The Application may contain something similar to the feedback which is already under the consideration; and
  • Under any circumstances, you are not authorized to obtain any kind of compensation or reimbursement from the Company for the feedback, unless specified.
  • Under no circumstances company shall be held responsible for any content provided by other users even such content is offensive, hurtful or offensive. While using the application, one must be cautious about providing the kind of content.
